These Terms and Conditions ("the Terms and Conditions") govern your ("the User") use of the www.llegamus.com ("Provider") website located at the domain name www.llegamus.com ("the Website"). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the website for marketing and other purposes without the consent of the Provider. The User may access, display, use, download and/or otherwise copy or distribute Content obtained on the website for his or her own use only. Use of the website on behalf of a third party, or for research, or for advertisement is strictly prohibited.
By using this Website or communicating with the Provider by electronic means, the user consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing in accordance with the applicable law as defined below..
The Website www.llegamus.com sells a tool to fill out and print out DACA related forms with the intent that the user file them on his or her behalf, via US Mail, with USCIS. The Website www.llegamus.com sells the ability for the user to store his or her information for subsequent DACA related form filings. The use of any product or service bought from this Website is at the purchaser's risk. The purchaser/user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.
The Website www.llegamus.com and its parent company, Immigrationrobot d/b/a llegamus.com are not part of the US or any state government, they are not law firms, they do not provide legal services and they do not provide legal advice.
The private information required for executing the orders placed through the e-commerce facility, namely the User's personal information as required in the relevant USCIS forms, and the user's credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Credit card details are not kept by the Provider under any circumstances.
The Provider cannot be held responsible for security breaches occurring on the User's electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.
The Provider will supply all goods to the delivery company in good order. These goods consist of the properly filled out and relevant USCIS forms for the user's required DACA purpose. It is up to the user to properly fill out the relevant USCIS forms.
All online credit card payments are processed by the Stripe, Inc., Internet Payment Gateway. Card Holders may go to www.stripe.com to view Stripe's security policies.
There is no refund or cancellation once the User pays www.llegamus.com.
The Provider reserves the right to cancel an order for which payment has already been received. This may occur if, for example, the User's information does not meet the Provider's standards. Should the Provider exercise this right, the User will receive a full refund with no deductions.
Any complaints regarding the standard and quality of the product or products bought by consumers through the e-commerce facility should be directed to the Provider.
The Provider reserves the rights to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User's obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User's continued use of this Website following the posting of changes or updates will be considered notice of the User's acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.
Provider provides certain information at the Website. Content currently or anticipated to be displayed at this Website is provided by Provider, its affiliates and/or subsidiary, or any other third party owners of such content, and includes but is not limited to logos, typography, front end architecture, software architecture, Published Editions and Computer Programs ("the Content"). All such proprietary works, and the compilation of the proprietary works, are copyright the Provider, its affiliates or subsidiary, or any other third party owner of such rights ("the Owners"), and is protected by United States and international copyright laws.
The Provider reserves the right to make any changes to the Website, the Content, or to products and/or services offered through the Website at any times and without notice. All rights in and to the Content is reserved and retained by the Owners. The Website, and all the Content on the Website, as well as the services that www.llegamus.com and its parent company provide are up to date in terms of compliance with the known state of the relevant USCIS forms the User downloads on the day of the download. That is, the Website, www.llegamus.com, and its parent company are not liable for any changes in the relevant USCIS forms that take place after the user downloads them. The User is strongly encouraged to immediately mail the forms downloaded from the Provider.
Neither Provider nor any holding company, affiliate or subsidiary of Provider, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if Provider is expressly advised thereof.
User and Provider agree that, except for disputes that qualify for Pennsylvania state courts of limited jurisdiction (such as small claims, justice of the peace, magistrate court, and similar courts with monetary limits on their jurisdictions over civil disputes), any controversy or claim, whether at law or equity, arising out of or related to the provision of services by www.llegamus.com or its parent company, regardless of the date of accrual of such dispute, shall be resolved in its entirety by individual (not class-wide nor collective) binding arbitration.
The User may visit the Website without providing any personal information. Because the Provider, its web page www.llegamus.com and its parent company are Pennsylvania based, only Pennsylvania-based privacy regulations apply to this service.
This Website is controlled, operated and administered by Provider from its offices within the Commonwealth of Pennsylvania. Access to the Website from territories or countries where the Content or purchase of the products sold on the Website is illegal is prohibited. If the User accesses this Website from locations outside of Pennsylvania, that User is responsible for compliance with all local laws.
These Terms and Conditions shall be governed by the laws of the Commonwealth of Pennsylvania, and the User consents to the jurisdiction of the Court of Common Pleas for Philadelphia County in the event of any dispute. The exclusive jurisdiction for any claim, case, or controversy arising out of or relating to this Agreement (whether for breach of contract, tort or otherwise) shall be the Court of Common Pleas for Philadelphia County, and the parties hereby consent to such exclusive jurisdiction and irrevocably waive and shall not assert any defenses based on lack of in personam jurisdiction, improper venue or inconvenient forum.
If any of the provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect.
You expressly acknowledge having reviewed, understood and agreed to these Terms and Conditions and the instructions and other language in the Provider's website, www.llegamus.com whether explicitly stated or through a hyperlink, and accept their application. In the case of a conflict between the terms of these Terms and Conditions of Service or the hyperlinks on the www.llegamus.com website on the one hand, and these Terms on the other, these Terms shall control as to the Service. I. Exercising Access, Data Portability, and Deletion Rights
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by contacting us. Only you, or a person registered with the California Secretary of State whom you authorize to act on your behalf, may make a verifiable consumer request related to your personal information.
You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice in 12 months.
The verifiable consumer request must
Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and
Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
J. Response Timing and Format
We endeavor to respond to a verifiable consumer request within 45 days of receipt. If we need more time (up to 90 days), we will inform you of the reason and extension in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12 months preceding the verifiable consumer request's receipt. The response we provide will also explain why we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily usable and allow you to easily transmit the information from one entity to another.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
K. Personal Information Sales Opt-Out and Opt-In Rights
If you are 16 years of age or older, you have the right to direct us not to sell your personal information at any time (the "right to opt-out"). We do not sell the personal information of consumers we know are less than 16 years of age unless we receive affirmative authorization (the "right to opt-in") from either the consumer who is between 13 and 16 years of age or the parent or guardian of a consumer who is between 13 and 16 years of age.
